CEO Tim Cook says Apple has refused to settle with the government in its eBook pricing anti-trust case against the iPhone maker because the company has done nothing wrong.
Cook said Apple refused to settle because the U.S. Justice Department asked the company to sign a document admitting wrongdoing. Cook added that he does not believe Apple has done anything wrong.
“We’re not going to sign something that says we did something that we didn’t do, so we’re going to fight,” Cook said in an interview at the D11 conference Tuesday night (May 29).
The Justice Department, in a recent court filing, called Apple the ringleader in a plot to raise eBook prices “to strip retailers of pricing authority.”
The government filed its lawsuit against Apple and the five publishers April 11, 2012, accusing the group of plotting to eradicate retail price competition, resulting in customers forking out more for their eBooks. The department’s Anti-trust Division previously settled its claims against Hachette Book Group Inc., HarperCollins Publishers L.L.C., Penguin Group (USA) Inc., Simon & Schuster Inc. and, most recently, Macmillan Publishers.
Apple, in a recently filed court document, is denying the Justice Department’s accusations, saying no conspiracy existed between it and the publishers, according to Reuters. Instead, Apple contends, it was merely in negotiations with the publishers.
“Early — and constant — points of negotiation and contention were over Apple’s price caps and 30 percent commission. After Apple sent draft agency agreements to each publisher CEO on January 11, each immediately opposed Apple’s price tiers and caps,” the 81-page filing reads, according to Reuters.
Apple has described the lawsuit as “unfair, unlawful, and unprecedented.”
The trial is set to begin June 3. Cook will be required to testify.
